Law of Ukraine «On Consumer Rights Protection» dated May 12, 1991 No 1023 – XII, Article 9. Consumer rights when purchasing proper quality goods
1. The consumer has the right to demand to exchange nonfoods of proper quality for similar ones by the seller, who has sold the mentioned items of goods if such products do not meet the buyer`s requirements concerning form, dimension, style, color or size, or such products may not be used for the designated purpose for some other reasons.
The consumer has the right to exchange proper quality goods within fourteen days period which does not include purchase day unless the seller defines a longer period.
The exchange of proper quality goods may be carried out if the goods have not been used and preserved market conditions, consumer properties, stamps and labels as well as the payment document issued to the consumer along with the item of goods, which has been sold, is kept.
The goods, which may not be exchanged (returned) on the grounds mentioned in this article are determined by the Cabinet of Ministers of Ukraine.
2. When providing the exchange of the goods, there are no similar goods the consumer has the right to purchase any other goods from the available range with appropriate cost recalculation, or terminate the agreement and call in his/her money in the amount which is equal to the cost of the returned goods, or exchange the goods after the first delivery of such goods, if similar goods are not in stock. The seller is obligated to inform the customer about the delivery of goods a day of such a delivery
3. If the purchase and sales agreement is terminated, settlements with the consumer shall be performed on the basis of the price on the purchase date. Money paid for the goods shall be paid a day when the relevant agreement is terminated, but if the seller may not provide such a refund within the stated period, the parties may agree upon another date of repayment but no longer than within seven days.
