Lists of goods, which are subjects to restrictions or bannings regarding carrying across the border of Ukraine

I. According to the requirements of the Resolution of the Cabinet of Ministers of Ukraine, dated May, 21 2012 No. 436, the restrictions or prohibition concerning the movement of the following types of goods are set.

I.1. Drugs, psychotropic substances and precursors, as well as medicines containing drugs, psychotropic substances and precursors.

The list of drugs, psychotropic substances and precursors is defined by the Resolution of the Cabinet of Ministers Ukraine, dated May 6, 2000 No. 770 (the resolution is provided only in Ukrainian as the list of such goods is very large).

The movement of the specified goods across the customs border of Ukraine is possible only in the presence of the Authorization for the performance of the right to import (export) or transit of drugs, psychotropic substances or precursors of drugs and psychotropic substances that is issued by the authorized state body of Ukraine.

I.2. Cultural values: the pictures, drawings and pastels which are completely handmade (except for drawings of the goods item 4906 according to the Ukrainian Classification of Goods of External Economic Activity) and the other finished products which are ornamented or decorated by hand; collages and similar decorative images, originals of engravings, prints and lithographs, originals of sculptures and figurines made from any materials, postage or revenue stamp, postage objects which are obliterated, including onces of the first day of obliteration, mail clerical objects (stamped paper) and the similar objects that are used or unused (except for goods of the goods item 4907 according to the Ukrainian Classification of Goods of External Economic Activity), collections and objects of a collecting of zoology, botany, mineralogy, anatomy or ones which represent historical, archaeological, paleontologic, ethnographic or numismatical interest, antique of more than 100 years.

Export of the specified cultural values outside the customs area of Ukraine is possible only in the presence of the Entitlement for the right to export (temporary export) of cultural values issued by the authorized state body of Ukraine.

The movement across the customs border of Ukraine without obtaining the above-stated Entitlement is allowed only for the following items: souvenir products, objects of cultural and applied purpose of serial and mass production which list is established by the Ministry of Culture of Ukraine.

I.3. Probes of plants and seeds of such plants: bulbs, tubers, root tubers, bulbous tubers, rhizomes, including limby rhizomes (in a condition of a vegetative rest, in a condition of vegetation or blossoming), rootstocks, plants and roots of chicory (except for roots of the goods item 1212 according to the Ukrainian Classification of Goods of External Economic Activity), other live plants (including roots of such plants), pitchers and stocks, seed potatoes, garden onion, seed wheat and mix of wheat and rye (meslin) seed, seed rye, seed barley, seed oats, seed corn, buckwheat, copra, seed millet; seeds of a ribbon grass and other seed grain crops, as well as the following plants for crops: vegetable legumes, rice, grain sorghum, soy beans, peanut, glucid (flax seeds), rapeseeds, oilseeds, seeds, fruits and sporules.

The movement of the specified goods across the customs border of Ukraine is possible only in the presence of the Notification of import of probes of plant varieties for the examination as to the suitability for the distribution of the relevant variety issued by the authorized state body of Ukraine.

I.4. Materials for military use and dual- use goods which shall be transported under the Permission and the Conclusion report for the carrying out international transfers.

Herewith, according to the provisions of the article 1 of the Law of Ukraine “On the state control over the international transfers of material for military use and dual-use goods", dated February 20, 2003 No. 549-IV, dual – use goods are the selective number of products, equipment, materials, software and technologies which are not designated specifically for military use, as well as services (technical assistance) related to such goods; such goods besides civilian designation may be used for the military or terrorist purposes or for the development, production, use of materials for military use, weapons of mass destruction, delivery systems of such weapons or nuclear destructive devices, including specific nuclear materials, chemicals, bacteriological, biological and toxic medicines.

The list of dual-use goods is established by the resolution of the Cabinet of Ministers of Ukraine "On the procedure of the state control over the international transfers of dual-use goods" dated January 28, 2004 No. 86 (the resolution is provided only in Ukrainian as the list of such goods is very large).

In turn, according to the provisions of the article 1 of the Law of Ukraine "On the state control over the international transfers of materials for military use and dual- use goods", dated February 20, 2003 No. 549-IV, materials for military use are arms, ammunition, military and special equipment, special components for production of such goods, explosives, as well as the materials and equipment which are specially intended for the development, production or use of the specified products.

The list of materials for military use is established by the resolution of the Cabinet of Ministers of Ukraine "On the procedure of the state control over the international transfers of materials for military use", dated November 20, 2003 No. 1807 (the resolution is provided only in Ukrainian as the list of such goods is very large).

I.5. Fishing products and fishing food preparations of a foreign proceeding (not from Ukraine) which are forbidden to be moved across the customs border of Ukraine without the appropriate Veterinary certificate: fresh-water, sea, anadromous and catadromous fish at all stages of development:

  • Fresh-water, sea, anadromous and catadromous fish at all stages of development, only whole, fresh,
  • Crustaceans, only whole, live, fresh,
  • Mollusks, only whole, live, fresh,
  • Water invertebrates, only whole, live, fresh,
  • Natural Spongia of animal origin, raw.

I.6. Radioactive materials (sources atomic radiation, radionuclides, nuclear materials, radioactive waste), as well as the radioactive materials which are contained in the structure of apparatus, equipment, facilities, devices (gamma defectoscopes, radio isotope therapeutic devices, radiation gamma-ray equipment, wells geophysical equipment, devices for measurement of density, level and others) which are forbidden to be transported across the customs border of Ukraine without the Authority for the transportation of radioactive materials issued by the authorized state body of Ukraine.

I.7. The following radio-electronic means and radiating devices of a special purpose which are forbidden to be moved across the customs border of Ukraine without the Authorization for import of radio-electronic means and radiating devices of a special purpose issued by the authorized state body of Ukraine, or the Confirmation of the General Staff of the Armed Forces of Ukraine of the fact that radio-electronic means and radiating devices of a special purpose belong to ones which may be used within Ukraine:

  • Telephone sets, including telephone sets for cellular communication networks and other wireless communication networks; the other equipment for transfer or acceptance of voice, images and other information, including the equipment for communication in wire or wireless network communication (for example, in a local or global communication networks), except for the transferring or receiver equipment of the goods items 8443, 8525, 8527 or 8528 according to the Ukrainian Classification of Goods of External Economic Activity,
  • The equipment transferring for broadcasting or television which include or do not include the receiver, sound recording or sound-reproducing equipment; TV cameras; digital cameras and recording video cameras,
  • Radar, radio navigational devices and radio equipment for remote control,
  • The receiver equipment for broadcasting that is combined or not combined in one body with the sound recording or sound-reproducing equipment or clocks,
  • Monitors and projectors which do not include television equipment; the receiver equipment for television which is combined or not combined with the broadcasting receiver or with the device which writes down or reproduces a sound or image,
  • - The parts intended only or generally for the equipment of the goods items 8525-8528 according to the Ukrainian Classification of Goods of External Economic Activity
  • Electric sound or visual signaling equipment (for example, alarms, sirens, display panels, thefts and fires alarms), except for the equipment of the goods items 8512 or 8530 according to the Ukrainian Classification of Goods of External Economic Activity.

I. 8. The resolution of the Cabinet of Ministers of Ukraine, dated May 21, 2012 No. 436 also establishes the lists of other goods which transportation across the customs border of Ukraine is limited. However the specified lists are not detailed in this instructions as far as in general such goods are used only for the purpose of business activity and the procedure of obtaining permissions for the transportation of such goods is not complicated and does not cause considerable difficulties.

II. An additional point is that the other Resolution of the Cabinet of Ministers of Ukraine, dated May 28, 2012 No. 468 "On the approval of the list of goods, which export (transmission) by citizens outside the customs area of Ukraine is not allowed" establishes a ban on the export (transmission) of the following classes of goods:

  • Feather suitable for stuffing; down, raw,
  • Rare-earth metals, scandium and yttrium in a pure form, in mixes or alloys,
  • Mercury,
  • Raw skins of cattle (including buffalo) or animals of equidae (fresh or salty, dried, limed, pickled or tinned in a different way, but not tanned, not developed under parchment and are not subject to further processing), with indumentum or without indumentum, split or not split,
  • Raw skins of sheep or lamb skins (fresh or salty, dried, limed, pickled or tinned in a different way, but not tanned, not manufactured under parchment or are not subject to further processing), with a wool cover or without wool cover,  split or not split, except for ones specified in the note 1(c) to this group,
  • Raw skins of pigs (pair or salty, dried, limed, pickled or tinned in a different way, but not tanned, not manufactured under parchment or are not subject to further processing), with indumentum or without indumentum, split or not split,
  • Firewood in the form of logs, billets, twigs, branches and similar,
  • Chipped wood or wood wool of softwood,
  • Chipped wood or wood wool of hardwood,
  • Raw timbers, that are sanded up or are not sanded up, rough squared or not squared,
  • Cooper's workshop wood; chopped logs; wood piles and stakes that are attenuated but not swan up lengthwise; hewn or rounded wood , but not turned, not elongated, and not processed in a different way, used for production of sticks, umbrellas, handles for tools and so forth; wood in the form of chips, plates, tapes and such other,
  • Wooden sleeper for railway or similar tracks,
  • Sawn up or planed along wood, chipped or hulled, squared or crude, polished or not polished, connected or not connected in a thorn of more than 6 mm thick,
  • Silver (including silver with a gold or platinum covering) in a raw or semi processed form, or in the form of powder,
  • Gold (including gold with platinum covering) in a raw or semi processed form, or in the form of powder,
  • Platinum in a raw or semi processed form, or in the form of powder,
  • Scrap and waste of precious metals or metals clad with precious metals; other waste or scrap with the content of precious metals or compounds of precious metals mainly used for the extraction of precious metals,
  • Articles of precious metals or metals clad with precious metals
  • Ferroalloys,
  • Cast iron waste and scrap,
  • Corrosion-resistant (stainless) steel waste and scrap,
  • Alloy steel waste and scrap, except for corrosion-resisting (stainless),
  • Ferrous metals waste and scrap, tin-plated,
  • Turning chip, scraps, fragments, waste of milling production and sawdust,
  • Waste, scissel or stamping of ferrous metals (fagoted),
  • Waste, scissel or stamping of ferrous metals (in bulk),
  • Ferrous metals waste and scrap, shredded (cut)
  • Ferrous metals waste and scrap (fagoted),
  • Ferrous metals waste and scrap (in bulk),
  • Remelting scrap ingots of iron or steel (remelting scrap ingots),
  • Ingots and other primary forms of corrosion-resisting (stainless) steel,
  • Copper mattes; cement copper (cement),
  • Unrefined copper, copper anodes for electrolytic refining,
  • Vayerbarsa (metal castings for the production of wire) manufactured from the refined copper,
  • Tickets (metal castings of square or round transverse section for the subsequent rolling of sections) manufactured from the refined copper,
  • Products manufactured from the refined copper except for cathodes and sections of cathodes, vayerbars and tickets,
  • Alloys on the basis of copper and zinc (brass),
  • Alloys on the basis of copper and tin (bronze),
  • Copper alloys (except for ligatures),
  • Copper waste and scrap,
  • Ligatures on the basis of copper,
  • Powders and scales of copper,
  • Сopper bars, whetstones and profiles,
  • Cooper wire,
  • Plates, sheets and tapes from copper more than 0,15 mm thickness,
  • Copper products without carving, except for washers,
  • Copper products with a carving, except for screws, bolts and nuts,
  • Table wear, kitchen or other household products and parts of such goods, copper, except sponges for cleaning kitchen ware, pads for cleaning or polishing, gloves and similar products, household appliances for preparation or a warming up of food, not electric and  parts of such products,
  • Copper products,
  • Raw nickel,
  • Nickel waste and scrap,
  • Nickel powders and scales,
  • Nickel rods, bars, profiles and wire,
  • Nickel plates, sheets, tapes and foils,
  • Nickel pipes, tubes and fitting for such items(for example, couplings, knee, flanges),
  • Nickel products,
  • Aluminum waste and scrap,
  • Unwrought lead,
  • Lead waste and scrap,
  • Zinc waste and scrap,
  • Tin raw,
  • Tin waste and scrap,
  • Tin bars, whetstones, profiles and wire,
  • Tin products,
  • Tungsten and tungsten products, including waste and scrap,
  • Molybdenum and molybdenum products, including waste and scrap,
  • Tantalum and tantalum products, including waste and scrap,
  • Magnesium and magnesium products, including waste and scrap,
  • Cobalt mattes and other intermediate products of metallurgy of cobalt; cobalt and cobalt products, including waste and scrap,
  • Bismuth and bismuth products, including waste and scrap,
  • Cadmium and cadmium products, including waste and scrap,
  • Titanium and titanium products, including waste and scrap,
  • Zirconium and zirconium products, including waste and scrap,
  • Antimony and antimony products, including waste and scrap,
  • Manganese and manganese products, including waste and scrap,
  • Beryllium, chrome, germanium, vanadium, gallium, hafnium (celtium), indium, niobium (        columbium), rhenium and tallium, as well as products manufactured from such metals, including waste and scrap,
  • Metal ceramics and metal ceramics products, including waste and scrap.
