“Procedure fof Filling in Customs Declaration for the Written Declaration of Goods Transported Across the Customs Border of Ukraine by Citizens for Personal, Family and other Needs, which are not Related to Entrepreneurial Activities”, approved by the Order of the Ministry of Finance of Ukraine dated May 28, 2012 No 614

1.General Provisions

1.3. The customs declaration for individuals shall be filled in personally by the citizen, who has reached the age of 16 years old or by the citizen’s authorized person and certified by the citizen’s signature before bringing the goods for the customs control. Information about the goods transported across the customs border of Ukraine by citizens, who have not reached the age of 16 years old and/or disabled persons or persons, whose civil capacity is limited, is specified in the declarations of the accompanying persons.

When declaring goods the authorized person shall record “Per Power of Attorney” in the upper left corner of the front and/or back side of the customs declaration for individuals and specify details of the notarized power of attorney (date, document serial number upon availability), as well as the principal’s forename, patronym, surname and number and series of the passport document.

1.4. The declaration shall be filled in a single copy, except for cases established by this Procedure.

1.5. When filling in the customs declaration for individuals the information shall be indicated in official languages of customs unions, to which Ukraine belongs, or in other foreign language of international communication (Ukrainian, Russian, English, French, Spanish, Arabic and Chinese).

1.6. Items and sub-items of the customs declaration for individuals, which require the answer “Yes” or “No”, shall be filled in by affixing X-note in the corresponding frame. If the note was affixed in the frame “Yes”, the boxes of the tables shall be filled in with the required information, which specifies the relevant item of the customs declaration.

The information, which did go in on one form of the customs declaration for individuals (on the basic list), shall be indicated by the citizen on separate forms of the customs declaration for individuals (additional lists).

In this case, the information indicated in the item 1 shall be duplicated to the additional lists, whereas the items, which are not applied, shall be crossed out with a Z-shaped line.

Herewith, the citizen shall record “Additional List” in the upper right corner of the front side of each additional list of the customs declaration for individuals. The filled in additional lists are an integral part of the customs declaration for individuals.

1.7. Customs officials are not entitled to fill in the customs declaration for individuals, change or supplement the information specified in the customs declaration for individuals, except for making entries related to the competence of the customs authorities.

1.8. The customs declaration for individuals shall not be accepted to customs clearance by the customs officer in the following case:

  • filling in the declaration form, which differs from the prescribed form;
  • filling in the declaration with violation of the established Procedure;
  • filling in the declaration in pencil;
  • filling in the declaration with corrections and/or erasures.

In such cases, the citizen or the authorized person shall fill in a new declaration in compliance with the established Procedure.

1.9. Along with the declaration, which is filled in accordance with this Procedure, the citizen or authorized person, depending on the type and purpose of travel, mode of transport, name of product, method of travel, and other factors affecting the customs procedure, shall submit the following documents for the customs control and customs clearance of the goods:

  1. identity documents and documents confirming the country of permanent residence of the citizen or authorized person:
  • passport or other citizen’s document, which gives the right to cross the state border of Ukraine. The citizen or authorized person, who did not cross the border, may submit the passport of the Ukrainian citizen;
  • documents confirming the citizenship (nationality) of the citizen;
  • documents confirming the country of permanent residence of the citizen (with appropriate notes);
  1. cash-memo, labels, invoices and other documents, which may be identified with the submitted goods or other document evidencing the value of goods (upon availability);
  2. commodity-transport documents for goods transportation: railway consignment note (УМВД/СМГС, ЦИМ/CIM, ЦИМ/УМВД (CIM/SMGS, ЦИМ/СМГС), air waybill (Air Waybill), Bill of Lading, waybill (CMR), luggage documents etc. (upon availability);
  3. documents confirming the right to apply the tax exemption (upon availability);
  4. documents issued by public authorities in accordance with the legislative acts for the implementation of customs control and customs clearance of goods transported across the customs border of Ukraine (in cases provided for by the legislation of Ukraine);
  5. documents confirming the right to perform activities related to the bringing goods to customs authorities for the customs control and customs clearance when transporting such goods across the customs border of Ukraine or disposition of the mentioned goods in other way (upon availability);
  6. documents confirming the ownership of the vehicle for a personal use;
  7. the obligation to re-import/re-export or transit the goods;
  8. documents confirming cash withdrawal from the accounts of banks (financial institutions).

1.10. The declaration is a document certifying facts of legal significance and the citizen or authorized person shall be liable for submitting the unreliable information provided in the customs declaration upon the acceptance of the declaration by the customs officer for the registration.

1.11. The fact of exercising the types of control provided for by the legislation for goods transported across the customs border of Ukraine by citizens in the cases established by the legislation of Ukraine is verified by affixing stamps (stamps, seals) on the results of control in the submitted shipping documents or declaration.

1.12. The documents or copies thereof (only the originals of the documents in cases provided for by the legislation), provided for the customs clearance of goods, which are the basis for their passing across the customs border of Ukraine and customs clearance, remain in materials of the customs authority, except for the cases provided for by this Procedure.

Any documents or copies thereof that remain in the materials of the customs authority shall be certified with a personal numbered seal of the official of the customs authority who carried out the customs clearance of goods.

1.13. The declaration legalized by the customs official and stamped with the official’s personal numbered seal, shall be granted to the citizen or authorized person, except for cases provided for by this Procedure.

1.14. The declaration legalized by the customs official in accordance with the Chapter III of this Procedure, is the basis for further transportation of the goods across the customs border of Ukraine by the citizen or authorized person under the compliance with the legislation on customs.

2. The procedure of filling in the boxes of the declaration by the citizen

2.1. The X-type note shall be placed in the corresponding frame of the field for the determination of the direction of transportation of goods across the customs border of Ukraine (entrance, departure).

2.2. The Item 1 «Personal Data» shall be filled in by the entering the documented data about the foreigner or authorized person:

  • family name, first name, paternal name (upon availability);
  • country of permanent residence;
  • citizenship (nationality), except for the stateless persons;
  • identity document;
  • countries of the foreigner's arrival and destination (in accordance with documents confirming the route, upon availability);
  • availability (absence) of children under 16 years old, who are accompanied by the foreigner or who cross the customs border of Ukraine with the foreigner, indicating the number (in numbers and in words) of children.

2.3. The data about the children under 16 years old and/or incapable persons or persons, whose civil capacity is limited and who are accompanied by the foreigner, who fills in the declaration, shall be indicated in the upper left corner of the front and/or back side of the customs declaration for individuals with indication of the degree of kinship and/or fact of incapacity (limited legal capacity) of the accompanying person.

2.4. The data on hand luggage, foreigner’s accompanied and unaccompanied luggage and cargo departure (for goods that are separately shipped by transport) shall be indicated in the Item 2 “Information about a method of goods transportation”.

2.5. The data about the availability (non-availability) of hand luggage, luggage accompanied, as well as about the amount of packages shall be indicated in the Sub-item 2.1 “Luggage accompanied, hand luggage”.

The amount of packages for the luggage accompanied, which lagged behind the foreigner (upon availability), shall be indicated in brackets after the indication of the amount of packages for the luggage accompanied and hand luggage.

2.6. The data about the availability (non-availability) of unaccompanied luggage and the amount of packages shall be indicated in the Sub-item 2.2 “Unaccompanied Luggage”.

The filling in of the Sub-item 2.2 shall be carried out on the basis of the luggage documents certifying the existence of such luggage.

2.7. The Sub-item 2.3 “Cargo Departures” shall be filled in if the foreigner sends goods from Ukraine outside the customs territory of Ukraine in a cargo shipment.

2.8. The data about the goods, which are declared by the foreigner or authorized person, shall be entered in the Item 3 “Information about available goods”.

2.8.1. The Sub-item 3.1 “Information about the national currency of Ukraine and foreign currency in cash, payment documents and other valuable security, banking metals” shall be filled in by the foreigner, if the currency values, which shall be declared in written form, are transported.

The data about the currency values, which may be transported across the customs border of Ukraine under the oral declaring, may be indicated in the customs declaration for individuals at the foreigner’s will.

The foreigner is not required to indicate in the customs declaration for individuals information about the available currency values, the sum of which does not exceed the equivalent of 10 000,00 euros and shall not be declared in written, even if the foreigner fills in the customs declaration for individuals upon the request of the official of the customs authority. In this case the X-form note may be placed in the frame “No”.

The title of the currency values (national currency of Ukraine and foreign currency, banking metals and other currency values) shall be indicated in the box “Title of currency valuables” of the table of the Sub-item 3.1.

In the box “Sum/amount” of the table of the Sub-item 3.1 shall be indicated (in numbers and in words):

  • sum – for the currency of Ukraine, foreign currency;
  • weight in grams – for banking metals;
  • number of units and nominal value (the nominal value shall be entered if it is indicated in such currency values) – for other currency values.

2.8.2. The detailed information about the vehicle for personal use, which is temporally imported into the customs territory of Ukraine (including with the purpose of transit) or is re-exported out of customs territory of Ukraine shall be indicated in the Sub-item 3.2 “Vehicle for personal use”.

Upon the availability of such a vehicle the X-note mark is placed in the required frame of the field for indication of the purpose of transportation of the vehicle for personal use.

2.8.3. The filling in of the Sub-item 3.3 “The goods, transportation of which across the state border of Ukraine is limited (to be carried out under permission documents, which are granted by the executive authorities) or prohibited” is performed by placing a note in the required frame: “Yes” under the availability of the goods for such a transportation, “No” if there are no goods for such a transportation.

2.9. In the Item 4 “Information about the goods, which shall be declared in written form and/or are subjects to custom duties, goods, transportation of which across the state border of Ukraine is prohibited or may be carried out under permission documents, which are granted by the executive authorities, and other goods, which are declared in writing at will of the citizen or at order of the customs authority” the following detailed information about:

The order number of each declared item of goods shall be placed in the box “Item No” of the table of the Item 4.

Precise information about the goods, which is necessary for identification (names, characteristics of goods, distinctive features and so on) shall be indicated in the box “Name and other distinctive characteristics of the item of goods, serial number and issuance date of the permissive document and the authority, which has granted the document” of the table of the Item 4, as well as the following requisites:

  • of the permission documents (title, number and issuance date of the permission document as well as the name of the authority, which issued it) – in case of the goods declaring with submission of permission documents, which are the basis for passing of such goods across the customs border of Ukraine;
  • of the documents, which are the affirmation of the tax exemptions (type, number and issuance date of the document), - during customs clearance of goods, which are subject to tax exemptions.

The weight or amount of the declared goods per every item of goods shall be indicated (in numbers and in words) in the box “Weight/Amount” of the table of the Item 4.

The invoice value of the declared goods shall be indicated in the box “Cost in national currency of Ukraine or in euro” of the table of the Item 4.

The foreigner shall place the record “Personal belongings” before the list of goods for personal use, which are declared at the foreigner’s will or at the request of the official of the customs authority.

2.10. The foreigner or authorized person places the signature and date of the filling in of the customs declaration for individuals in the fields for signature and date; the date shall coincide with the date of the submission of the customs declaration for individuals for the customs clearance.

3. Customs authority official’s actions when including to the declaration the data, which are related to the competence of customs authorities

3.4. The official of the customs department of the income, duties and fees agencies of Ukraine verifies the customs declaration for individuals with the signature, places the time of completion of customs clearance and affix a personal numbered seal in the box “For office use only”; the mentioned procedure is the completion of customs clearance of the goods, specified in the customs declaration for individuals.
